6.- Acceptance of the General Terms of Contract
These Terms apply to contracting the initial legal consultation, whether booked through this website, by telephone or by WhatsApp. By completing the booking or confirming the appointment through any of these channels, the Client fully and unreservedly accepts these terms.
As this is an electronic contract, the signature is replaced by acceptance of these General Terms.
7.- Duration
These Terms are in force from the date of publication and until replaced by a later version. Each booking is governed by the terms in force at the time it is made, regardless of any amendments published afterwards. Later amendments do not affect bookings already confirmed.
8.- Subject matter and scope of the consultation
The contract covers a paid initial legal consultation, of up to 50 minutes, in the areas of Criminal, Civil and Employment law. It may be provided in person at the office on Rambla Just Oliveras stated in the booking or, where agreed, by telephone or video call.
Unless expressly stated otherwise, the consultation includes receiving and organising the relevant facts, giving an initial legal assessment based on the information available during the session, explaining options, risks and next steps, and reviewing the documents that can reasonably be examined within that time.
The consultation does not include, unless separately contracted: the separate or exhaustive study of documents, written opinions, drafting or filing of submissions, review of contracts or appeals, communications with third parties, entering an appearance, attendance at proceedings, representation, procedural defence, monitoring deadlines or any further steps.
Paying for and holding the consultation do not mean that Bravo Advocats agrees to take on the case or matter. Any subsequent engagement requires the firm's express acceptance, a conflict-of-interest check and an engagement letter setting out scope, those responsible, fees, expenses and terms.
9.- Capacity to contract and identity
To contract the consultation the Client must have the necessary legal capacity, which is taken to exist by the fact of requesting the service. If acting on behalf of another person or of a legal entity, the Client is taken to have sufficient authority, which Bravo Advocats may verify before providing the service.
The Client will provide truthful and sufficient data for identification and to check for possible conflicts of interest, including the identity of opposing or related parties. It is recommended not to send sensitive documents or a lengthy account of the matter until receiving instructions from the firm.
The person making the payment may be different from the Client, but paying does not make anyone a client, does not give any right to know the content of the consultation and does not limit the duty of professional secrecy.
10.- Language
The consultation is provided in Catalan or Spanish, at the Client's choice.
11.- Contracting process
The appointment may be booked through any of these channels:
- Through the booking section of Bravoadvocats.com, choosing the practice area and an available time in the firm's diary.
- By telephone or WhatsApp, through the firm's artificial intelligence assistant (Clara), which checks the actual diary and offers the available times.
In both cases the Client provides contact details and accepts the processing of that data before the appointment is finalised. Consent boxes are not pre-ticked and the Client may correct their details before confirming.
Once a time is chosen, it is held for fifteen minutes for the Client to complete payment by card or Bizum. The appointment is not confirmed until payment has been made; if it is not completed within that period, the slot is released automatically and becomes available to anyone else. If payment is made by bank transfer, section 13 applies.
Times are given in the Europe/Madrid time zone. Reminders will be sent by e-mail, WhatsApp or SMS before the appointment; no reminder reveals the matter being consulted on.
If, owing to force majeure, the Client cannot be attended on the agreed day or time, the firm will contact the Client to agree an alternative, either with another member of the team or at another time.
12.- Price
The total price of the initial consultation is:
| Consultation | Price (VAT included) | Maximum duration |
|---|---|---|
| Criminal | 150 € | 50 minutes |
| Civil | 100 € | 50 minutes |
| Employment | 100 € | 50 minutes |
Prices are shown inclusive of all taxes before the booking is completed. No handling fees or payment-method surcharges are applied.
If the matter were to require steps falling outside the scope of the consultation, this will be notified and quoted before they are carried out: no charge arises without prior acceptance.
Bravo Advocats reserves the right to change the price and the content of its services. Any such change will not apply retroactively to services already contracted.
13.- Method of payment and invoice
Payment is made in full and in advance: the appointment is not confirmed until the amount has been paid. The following means of payment are accepted; cash is not accepted:
- Credit or debit card, through the bank's virtual point-of-sale terminal, with strong customer authentication. The appointment is confirmed instantly.
- Bizum, through the same gateway. The appointment is confirmed instantly.
- Bank transfer. In this case the slot is held until the payment arrives, for 48 hours at most; if the payment has not arrived 24 hours before the visit, the slot is released. The appointment is not confirmed until the payment is verified. If the visit is less than 24 hours away, you can only pay by card or Bizum.
For visits in the next two days, card or Bizum is recommended: the appointment is confirmed at once, whereas a bank transfer may not arrive in time.
An invoice meeting the statutory requirements will be issued and sent by e-mail unless a paper copy is requested. If an invoice is required in the name of a legal entity, the Client must state this when booking or notify info@bravoadvocats.com before the appointment.
14.- Changes and cancellation by the Client
The Client may change or cancel the appointment by notifying the firm by telephone, by WhatsApp or at info@bravoadvocats.com.
The conditions on cancellation, changes and failure to attend apply without prejudice to the statutory right of withdrawal. If the consumer validly exercises that right before the service has been supplied in full, the amounts paid will be refunded, deducting only, where legally applicable, the proportionate amount corresponding to the services actually supplied at the client's express request.
- Cancelling or changing with 24 hours' notice or more: the amount is refunded or the date is changed.
- With less than 24 hours' notice: the appointment is rescheduled once, with no refund.
- Failing to attend without notice: the amount is retained, unless there is justified cause.
- If the failure to attend occurs within the withdrawal period and the client then requests a refund in time, the firm reviews the case: there is no automatic retention.
- Once the withdrawal period has expired, failing to attend without notice more than 15 minutes after the booked time means losing the full amount, save for duly justified force majeure.
- Justified force majeure: the appointment is rescheduled once at no cost.
- If the firm was unable to attend for reasons of its own: a full refund and a new consultation at no cost.
Please give as much notice as possible: a slot freed up in time lets someone else be seen.
15.- Right of withdrawal
Where the Client is a consumer and the contract was concluded at a distance, the Client may withdraw within 14 calendar days of its conclusion, without having to give reasons and without penalty. However, as this is a contract for the supply of services, the right is lost once the service has been performed in full at the Client's express request and once the Client has expressly acknowledged that loss, in accordance with article 103.a) of the Texto Refundido de la Ley General para la Defensa de los Consumidores y Usuarios (Spain's consolidated consumer protection act, Real Decreto Legislativo 1/2007).
To that end, before confirming the booking the Client is shown a box, which is not pre-ticked and is not required in order to book, with the following declaration, shown in English: «I expressly request that the consultation be provided before the statutory 14 calendar-day withdrawal period ends, and I acknowledge that, once the service has been provided in full, I will lose my right of withdrawal in respect of this contract.» If the Client does not tick the box, the right of withdrawal is kept even if the consultation has already been provided.
If the Client withdraws once the consultation has begun but has not finished, the Client must pay the amount proportionate to the service already provided.
Withdrawal may be notified by any unambiguous statement sent to info@bravoadvocats.com or to the firm's postal address. The refund will be made by the same means of payment used, within the 14 calendar days following receipt of the notification.
Model withdrawal form
You may use this model, but you are not required to. Complete and send it only if you wish to withdraw from the contract.
- To: Bravo Advocats Associats, S.L.U., Rambla Just Oliveras, 64, entresuelo 1.ª, Esc. A, 08901 L'Hospitalet de Llobregat (Barcelona), email info@bravoadvocats.com:
- I hereby give notice that I withdraw from my contract for the provision of the following service: initial legal consultation.
- Booked on: ____________________
- Name of consumer: ____________________
- Address of consumer: ____________________
- Signature of consumer (only if this form is notified on paper): ____________________
- Date: ____________________
16.- Cancellation or refusal by Bravo Advocats
Bravo Advocats may cancel or decline to provide the consultation because of a conflict of interest, inability to verify identity or authority to act, unsuitability of the service for the matter, a professional conduct reason, unforeseen unavailability or force majeure. In these cases, where possible and where there is no conflict, it will offer another lawyer or another date; the Client may decline the alternative. Any amount paid will be refunded in full.
Bravo Advocats is not required to disclose confidential information justifying a conflict of interest.
17.- Deadlines, urgent matters and steps not undertaken
Contracting a consultation does not suspend any legal or procedural deadline. Arrests, proceedings or deadlines due in less than 72 hours are referred immediately to human attention and are not handled as an ordinary consultation: the Client must not wait for the appointment if immediate action is needed.
If a court or administrative authority has given the Client a deadline, or if the matter is subject to a limitation or expiry period, the Client must state this when booking. Bravo Advocats is not liable for harm caused by a missed deadline in matters about which it did not receive timely information.
Until there is express acceptance and a subsequent written engagement, Bravo Advocats does not undertake the filing of submissions, entering an appearance, attendance, contact with authorities or monitoring of deadlines.
18.- Artificial intelligence assistant
Telephone and WhatsApp enquiries may be handled by an artificial intelligence assistant (Clara). Clara identifies herself as such from the first contact and states that the conversation is recorded and transcribed to handle the enquiry.
Clara can give general information, collect the minimum data needed, manage the diary and pass on requests, but does not give legal advice, does not accept matters, does not replace the lawyer and does not decide alone on conflicts or cancellations. Human attention may be requested at any time.
Anyone who does not wish to be recorded may say so and contact the firm by e-mail or in person.
19.- Communication with Bravo Advocats
The Client may send information relating to their case, make enquiries, report issues or request changes through the e-mail address info@bravoadvocats.com or the telephone number +34 93 337 58 04.
20.- Complaints
The Client may submit complaints to info@bravoadvocats.com, to the telephone number +34 93 337 58 04 or at the address given. Bravo Advocats will confirm receipt and reply as soon as possible and, at most, within one month.
Bravo Advocats has official complaint, claim and report forms available and, as a firm established in Catalonia, access to the consumer bodies of the Generalitat de Catalunya under the Catalan Consumer Code. It is not a member of any consumer arbitration scheme or consumer mediation procedure. This does not limit the Client's right to apply to public consumer bodies, to the Agència Catalana del Consum (Catalan Consumer Agency) or the local consumer information office, to the Il·lustre Col·legi de l'Advocacia de Barcelona (ICAB), which has a client care service and a professional conduct committee for disagreements over fees and over professional conduct, or to other legally available means.
21.- Retention of the contract
If the Client wishes to keep a copy of this document, it must be printed or downloaded. The firm keeps the accepted version and proof of booking for as long as needed to demonstrate and comply with the contractual, tax, accounting and complaints-related relationship, with restricted access.
22.- Data protection and confidentiality
All information supplied by the Client, in any format, is subject to the professional secrecy and confidentiality obligations that govern the legal profession, even if the matter is ultimately not accepted.
Data is processed in accordance with the Privacy Policy published at https://www.bravoadvocats.com/en/privacy-policy/ and the Legal Notice set out in sections 1 to 5 of this document.
23.- Applicable law
The contract is governed by Spanish law and by the consumer protection rules applicable in Catalonia, without prejudice to any mandatory rule more favourable to the Client.
24.- Jurisdiction and validity
Any dispute not resolved amicably will be submitted to the courts with jurisdiction under the law. If the Client is a consumer, the competent courts will be those determined by mandatory law, with no exclusive submission to the courts of Barcelona.
If any clause is held void or unenforceable, it will be treated as not included and the rest will remain valid, to be completed in accordance with mandatory law and good faith.
Sections 1 to 5 of this document, the Legal Notice, are published in Legal notice.
